Cargo insurance

In the process of international shipping the situations of cargo damage or loss, due to various circumstances, may arise. In this case, the customer shall make a complaint to the carrier/freight forwarder. In turn, the carrier/freight forwarder may admit its guilt, but pay only a small part of the cost of the lost cargo, referring to the limits of its liability.

Russian legislation and international conventions fix the limits of liability of the carrier/freight forwarder in international transport. The limit of liability of the international carrier for a kilogram of the total weight of lost, missing or damaged (corrupted) cargo may not exceed:

• For sea transportation 2 SDR/gross kg;
• For air transportation 17 SDR/gross kg;
• For road transportation 8.33 SDR/gross kg;
• For rail transportation 17 SDR/gross kg.

At the same time, the liability of the freight forwarder may not exceed 2 SDR. The SDR unit shall be established by IMF and one unit is approximately equal to US$1.5. The IMF website contains the exact value of the SDR unit in the currencies of different countries.

The carrier is not liable for loss or damage of cargo occurred in result of force majeure, fire, theft or other circumstances which have arisen not through its own fault and the fault of its employees or agents. The amount of liability of the carrier also may not exceed the actual cost of the goods. The actual cost of the goods is the cost of the goods supported by properly executed accompanying documents (CMR, Waybill, Invoice, Customs Declaration, etc.)
